MINUTES
August 28, 2019

 

I. PRELIMINARIES:

A. Call to Order

Chairman Juan Sablan called the meeting to order at 10:12 am on Wednesday, August 28, 2019 at the Conference Room located on the 2nd Floor of the Commission's main office at the Springs Plaza in Gualo Rai, Saipan.

B. Roll Call

Commissioners present at the meeting were: Juan M. Sablan (Chairman), Joseph C. Reyes (Vice Chairman), Ramon M. Dela Cruz (Secretary), Alvaro A. Santos (Treasurer) and Diego M. Songao (Public Affairs/Media Relations).

C. Adoption of Agenda

Vice Chairman Reyes made a motion to adopt the agenda, seconded by Commissioner Dela Cruz. The motion was put  to a vote and unanimously approved.

C. Adoption of Minutes: July 18, 2019 & July 31, 2019

Commissioner Dela Cruz made a motion to adopt the minutes of the July 18, 2019 and the July 31, 2019 meeting, seconded by Vice Chairman Reyes. The motion was put to a vote and unanimously approved.

II. REPORTS:

A. Report by the Chairman

Chairman Juan Sablan announced that the 9th Circuit Court of Appeals has denied Imperial Pacific International (CNMI), LLC, Grand Marianas, LLC and Imperial Pacific Properties, LLC TRO request and preliminary injunction in reference to the Commonwealth Casino Commission's release of IPl's complete financial statements for public viewing. He added that a preliminary injunction is not  a final judgement  and may still go back  to  the  court.

The Chairman reported that IPI has paid only $SM of the Annual License Fee, and should be paying the remaining balance of $10,502,570.00 which is inclusive of the Consumer Price Index (CPI) adjustment.

Chairman Sablan shared that the CCC provided comments on HLB 21-23, to impose a 10% gambling revenue tax in the Third Senatorial District. A copy of CCC comments was provided to Representative Ivan A. Blanco, Chairman of the Standing Committee on Ways and Means. The Chairman shared that one of CCC's comments is that the implementation of the 10% gambling revenue tax is premature to discuss at this time and recommended that the issue be revisited again upon completion  of  the Garapan project.
